General Terms and Conditions of Sale

 

Article 1. Purpose

These General Terms and Conditions of Sale govern the contractual relationship between:

La Collectionnerie SAS, a simplified joint-stock company with share capital of 1,000 euros, registered with the Cusset Trade and Companies Register under number 944 640 218, whose registered office is located at 12 rue du Jura, 03300 Cusset, hereinafter referred to as "the Seller", operating the website www.merlinetcompagnie.com,

and

any natural or legal person making a purchase via the website www.merlinetcompagnie.com, hereinafter referred to as "the Customer" or "the Buyer".

These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of goods offered by the Seller to the Customer.

Any order placed on the website implies the Customer’s full, complete and unconditional acceptance of these General Terms and Conditions of Sale. The Customer acknowledges having read them before placing an order.

Article 2. Products

The products offered for sale are those displayed on the website www.merlinetcompagnie.com, subject to availability. The Seller reserves the right to modify the product range at any time.

Each product is presented on the website in the form of a description sheet mentioning its main characteristics. The photographs are as accurate as possible, but cannot guarantee a perfect similarity with the product, particularly with regard to colours.

The products are offered for sale in the territories for which the Seller accepts delivery.

 

Article 3. Prices

The prices of the products displayed on the website are expressed in euros, inclusive of all taxes, including VAT at the rate in force on the day of the order. Any change in the rate may be reflected in the price of the products.

The prices indicated do not include delivery costs, which are charged in addition and indicated before the order is confirmed.

The Seller reserves the right to modify its prices at any time. However, the price listed in the catalogue on the day of the order shall be the only price applicable to the Customer.

 

Article 4. Orders and payment terms

Any order requires the creation of a customer account. The Customer undertakes to provide accurate and complete information when registering.

The Customer may place an order via the website by adding the desired products to the basket and following the ordering process.

The accepted payment methods are as follows:

  • Bank card via PayPal’s secure system,
  • PayPal account.

The order is considered final once payment has been validated.

An order confirmation is sent to the Customer by email.

 

Article 5. Retention of title

The Seller retains ownership of the products sold until the price has been effectively and fully received by the Seller.

 

Article 6. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the order to exercise the right of withdrawal, without having to provide any reason or pay any penalty.

La Collectionnerie SAS extends this period to 30 calendar days.

The Customer may notify the withdrawal by any unambiguous means. The refund will be made within a maximum period of 14 days following the recovery of the products or proof of their dispatch.

Return costs remain payable by the Customer.

Article 7. Delivery

The products are delivered to the address indicated by the Customer when placing the order.

Deliveries are carried out by La Poste (Colissimo). A tracking number is sent to the Customer.

The Seller undertakes to deliver the products within a maximum period of 30 days. In the event of this period being exceeded, the Customer may request cancellation of the sale and obtain a refund.

The risk of loss or damage to the products is transferred to the Customer when the Customer, or a third party designated by the Customer other than the carrier proposed by the Seller, takes physical possession of the products.

Where the Customer entrusts delivery to a carrier other than those proposed by the Seller, the risk is transferred to the Customer when the products are handed over to the carrier chosen by the Customer.

 

Article 8. Warranty

All products benefit from the legal guarantee of conformity provided for in Articles L217-3 et seq. of the French Consumer Code, as well as the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

The Customer has a period of two years from delivery of the goods to act under the legal guarantee of conformity. In the event of a lack of conformity, the Customer may request repair or replacement of the goods, free of charge, under the conditions provided for by the French Consumer Code.

The Customer may also act under the warranty against hidden defects provided for in Articles 1641 et seq. of the French Civil Code.

Article 9. Liability

The Seller may not be held liable for any damage resulting from the use of the Internet network, including loss of data, intrusion, viruses, service interruption or any other issue beyond its control.

 

Article 10. Intellectual property

All elements of the merlinetcompagnie.com website, including texts, images, graphics, logo and visual elements, are the exclusive property of La Collectionnerie SAS, unless otherwise stated. Any total or partial reproduction is prohibited without prior written authorisation.

 

Article 11. Personal data

The Seller processes the Customer’s personal data in compliance with the General Data Protection Regulation (GDPR) and the applicable regulations on the protection of personal data.

The Customer has the right to access, rectify, erase, object to and transfer their data. The Customer may exercise these rights by post or by email: contact@merlinetcompagnie.com.

Article 12. Complaints and mediation

In the event of a dispute between the Customer and the company, they shall endeavour to resolve it amicably. The Customer shall send a written complaint to the Seller or, where applicable, to the Seller’s Customer Relations Department.

In the absence of an amicable agreement or in the absence of a response from the Seller within a reasonable period of one (1) month, the consumer Customer within the meaning of Article L.612-2 of the French Consumer Code may, free of charge, if a disagreement persists, refer the matter to the competent mediator registered on the list of mediators established by the Commission for the Evaluation and Control of Consumer Mediation pursuant to Article L.615-1 of the French Consumer Code, namely:

Article 13 – Applicable law and competent jurisdiction

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, and failing an amicable resolution, the competent courts shall be determined in accordance with the rules of ordinary law, subject to the mandatory protective provisions applicable to consumers.

 

Article 14 – Extended Producer Responsibility (REP) – Unique Citeo identifier

In accordance with the provisions of the French Environmental Code relating to Extended Producer Responsibility (REP), La Collectionnerie SAS, operator of the Merlin&Cie website, is registered with Citeo for the household packaging sector.
